1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

For iOS users, your use of the Service is also subject to Apple's Standard End User License Agreement (EULA), which is incorporated herein by reference: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

Our Privacy Policy forms an integral part of these Terms and explains how personal data is processed when you use the Service.

2. Eligibility and Age Restrictions

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.

4. Subscriptions & Payments

Some parts of the Service are billed on a subscription basis ("Pro Access").

• Billing: Payment will be charged to your iTunes Account or Google Play Account at confirmation of purchase.
• Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
• Refunds: All billing and refund requests are handled exclusively by Apple (App Store) or Google (Play Store). Kogito does not process refunds directly.
• Fair Usage Policy: "Unlimited" features are subject to reasonable use limits. We may apply technical controls, temporary restrictions, or account actions where usage indicates abuse, fraud, or activity that risks platform stability or violates these Terms.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality (including but not limited to design, logos, and code) are and will remain the exclusive property of Kogito and its licensors.

6. User Content

Our Service allows you to upload notes, record audio, and store other information ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right to use, modify, perform, display, reproduce, and distribute such Content on and through the Service solely for the purpose of providing the Service to you (e.g., generating summaries). We do not sell your Content to third parties.

7. Prohibited Uses

You agree not to use the Service:

• To violate any national or international law.
• To attempt to exploit or harm minors.
• To upload content that infringes upon the rights of others.
• To generate harmful, fraudulent, or deceptive content using our AI tools.

8. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Turkey. Any disputes arising from or relating to the use of the Service shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
